All participants must read and agree to the terms and conditions of this document prior to participating in any sports-related activities (bouts, practices both on- and off-skates, other activities etc.) organised by B-Town Brawlers Roller Derby (BTBRD).
- Waiver for participation in all training, scrimmages, bouts, on- and off-skates activities and general activities with BTBRD.
1.1. The participant acknowledges and agrees that roller derby is a ‘high-risk’ sport and as such has many inherent dangers and risks, even when practised safely. These risks include injury or death to the participant and injury to their property.
1.2. The participant acknowledges that although BTBRD aims to practice and play roller derby and any related activities as safely as possible, it is unreasonable to expect the league to be responsible in any way for any injury to a participant or participant’s property, or for the death of a participant.
1.3. The participant releases, waives and discharges BTBRD, their officers, officials, servants, agents, volunteers, other participants and employees, including officers, officials, servants, agents, volunteers and employees of training venues, sponsors and advertisers from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by them, or to any property belonging to them, while participating in the sport of roller derby, or while on the premises where the event is being conducted. It is their expressed intent that this release and hold harmless agreement shall bind the member of their family and spouse, if they are alive, and their heirs, assigns, next of kin and personal representatives if they are deceased, and shall be deemed as a release, waive and discharge for the above named releasees.
1.4. This waiver, release and discharge shall be and operate separately in favour of BTBRD and all shires, government departments, persons, corporations and bodies involved with or otherwise engaged in promotion and staging of any activity or event, and the servants, agents, representatives and offices of all of the above.
1.5. The participant acknowledges that they have undertaken the activities of BTBRD freely, voluntarily and absolutely at their own will and at their own risk, with a full appreciation of the nature and risks involved in the sport of roller derby.
1.6. This waiver shall bind the participant and their executors, next of kin and any heirs.
1.7. The participant has read and understands this waiver of the participant’s legal rights.
- The participant agrees:
2.1. To the terms and conditions laid out in this document in consideration of and as a condition of acceptance of the participant’s entry into any activity conducted by BTBRD and its associates.
2.2. To acknowledge and comply with the BTBRD Safer Spaces Policy and Code Of Conduct as stipulated by BTBRD.
2.3. That this agreement shall be constructed in accordance with the laws of the United Kingdom.
- The participant acknowledges:
3.1. They have disclosed all information requested of them in the participation agreement.
3.2. They have sole responsibility for the security and safety of their athletic equipment and personal belongings at all time during any BTBRD, or associated, activity.
3.3. They have sole responsibility for wearing all required safety equipment in the proper manner while upright on skates. The required equipment is: helmet (for extreme sports, not a bicycle helmet), mouthguard, elbow pads, wrist guards and knee pads. Only quad skates are permitted. Eyeglasses must have plastic shatter-proof lenses.
3.4. They have not received any medical advice recommending them to not participate in roller derby, related activities or any high-intensity exercise.
3.5. It may be beneficial to them to disclose any medical conditions (physical or mental) to the coaching team that may mean a higher risk to themselves while participating in any activities, on- or off-skates, but that this is not compulsory.
3.6. The importance of instruction and coaching regarding activities and training and to obey these instructions to the best of their abilities, and to always ask if they are unsure of what is required of them from an activity or training session.
3.7. They are solely responsible for gauging their own safety in regards to certain activities, although representatives of BTBRD may step in if needed, the participant is solely responsible. For example, if the participant is ill or tired they may decide that they pose too much of a risk to themselves or others if they participated in any activity involving contact. BTBRD expect every participant to value safety above all else, and if they are told they are too much of a danger to themselves or others to continue with an activity by a representative of BTBRD, they must respect this decision and cease the activity immediately.
3.8. Spectators (patrons on the premises as a result of your involvement in roller derby, skating practice, public appearances, fundraising activities or any other sanctioned BTBRD activity) as well as participants must behave in a respectful manner to both person and property. Behaviour which could potentially lead to intentional or unintentional bodily injury or injury to property will not be tolerated. Spectators under the age of 18 will not be allowed in the skating area, which includes anywhere not separated by a physical boundary from the skating area.
3.9. They have read the foregoing text, understand it, and sign voluntarily of their own free act and deed: no oral representations, statements or inducements, apart from the foregoing written agreements have been made; and they execute this release for full adequate and complete consideration fully intending to be bound by the same. They understand that they have given up substantial rights by signing this.
